3.1 First-Party Cookies

First-party cookies are set or controlled by Zinifly or the Zinifly-powered domain you are visiting.

They may support:

  • authentication;
  • security;
  • account preferences;
  • Platform functionality;
  • payment flows;
  • consent preferences; and
  • analytics.

3.2 Third-Party Cookies

Third-party technologies may be provided by independent companies integrated with the Platform.

Depending on the Platform feature, those companies may provide services involving:

  • analytics;
  • payments;
  • maps;
  • fraud prevention;
  • customer support;
  • advertising;
  • social media;
  • video;
  • communications; or
  • other functionality.

Where required by applicable law, Zinifly will identify the relevant third-party provider, purpose, and applicable duration through this Policy, our cookie preference interface, or another appropriate notice.

Third-party providers may process information under their own privacy policies in addition to any contractual obligations they have to Zinifly.

CATEGORIES OF COOKIES WE USE

Zinifly may use the following categories of cookies.

4.1 STRICTLY NECESSARY COOKIES

Strictly Necessary Cookies are required to operate the Platform or provide functionality requested by the User.

They may be used for:

  • account authentication;
  • secure login sessions;
  • fraud prevention;
  • cybersecurity;
  • session management;
  • load balancing;
  • shopping-cart functionality;
  • payment security;
  • remembering privacy choices;
  • preventing duplicate submissions;
  • maintaining application state;
  • protecting forms from abuse;
  • and other essential Platform functions.

Examples may include cookies that:

  • keep a User logged into an account;
  • maintain a secure session;
  • remember items during checkout;
  • store the User's cookie preferences;
  • detect malicious requests; or
  • enable a requested payment transaction.

Because these technologies are necessary to provide requested functionality or secure the Platform, they generally cannot be disabled through Zinifly's cookie-consent interface.

You may block them through your browser, but doing so may prevent parts of the Platform from functioning properly.

4.2 FUNCTIONAL COOKIES

Functional Cookies support enhanced functionality and personalization.

They may remember:

  • language preferences;
  • regional settings;
  • dashboard preferences;
  • display settings;
  • form preferences;
  • Marketplace preferences;
  • previously selected options; and
  • accessibility-related preferences.

Depending on applicable law and the particular technology, Functional Cookies may require consent.

If you reject them, some personalized features may not function as intended.

4.3 ANALYTICS AND PERFORMANCE COOKIES

Analytics Cookies help Zinifly understand how Users interact with the Platform.

They may be used to measure:

  • page views;
  • website traffic;
  • visitor journeys;
  • session duration;
  • feature usage;
  • navigation patterns;
  • referring websites;
  • device and browser characteristics;
  • errors;
  • Platform performance;
  • marketing attribution;
  • conversion activity; and
  • aggregate usage patterns.

We may use analytics providers such as Google Analytics, subject to our current technical configuration.

Analytics information may include:

  • IP-derived information;
  • browser identifiers;
  • cookie identifiers;
  • device information;
  • page interactions; and
  • approximate geographic information.

Where applicable law requires consent before analytics technologies are stored or accessed, Zinifly will not intentionally activate non-exempt Analytics Cookies before obtaining the required consent.

You may withdraw analytics consent through our cookie preference controls.

4.4 ADVERTISING AND MARKETING COOKIES

Where enabled, Advertising and Marketing Cookies may be used to:

  • measure advertising campaigns;
  • identify advertising referrals;
  • perform conversion measurement;
  • create advertising audiences;
  • limit repeated advertising;
  • personalize advertising;
  • perform retargeting;
  • understand whether a User visited Zinifly after viewing an advertisement; and
  • measure the effectiveness of marketing campaigns.

These technologies may permit advertising providers to recognize a browser or device over time or across different online services.

Depending on applicable privacy law, the disclosure of information through these technologies may be considered:

  • a sale of personal information;
  • sharing for cross-context behavioral advertising; or
  • processing for targeted advertising,

even if Zinifly does not receive money in exchange for the information.

Where required, Advertising and Marketing Cookies will be disabled unless and until the User provides appropriate consent.

Where U.S. state law provides an opt-out right instead, Zinifly will provide applicable opt-out mechanisms as described below.

TECHNOLOGIES CURRENTLY OR POTENTIALLY USED BY ZINIFLY

The providers used by Zinifly may change as Platform features evolve.

Current or commonly integrated technologies may include the following.

Google Analytics

Purpose: Website and Platform analytics, performance measurement, traffic analysis, and campaign attribution.

Category: Analytics / Performance.

Google may receive technical information, browser identifiers, usage information, and related data according to Zinifly's configuration and Google's applicable terms.

Stripe

Purpose: Payment processing, fraud prevention, transaction security, identity verification, and payment-related functionality.

Category: Primarily Strictly Necessary / Payment Security.

Stripe may independently set or access technologies necessary to securely process payments and prevent fraud.

Mapbox

Purpose: Interactive maps, geographic visualization, venue-related functionality, and mapping features.

Category: Functional and/or Strictly Necessary depending on the feature requested.

Additional Providers

Zinifly may add or remove providers for:

  • analytics;
  • advertising;
  • payments;
  • fraud prevention;
  • customer support;
  • communications;
  • embedded media;
  • social integrations;
  • mapping; or
  • other Platform features.

Where applicable law requires disclosure of a particular provider before its technology is activated, the current provider will be identified through the Cookie Preference Center or other appropriate disclosure.

Zinifly should maintain its current technical cookie inventory so that the information presented to Users accurately reflects technologies actually deployed.

GLOBAL PRIVACY CONTROL AND UNIVERSAL OPT-OUT SIGNALS

Certain U.S. privacy laws permit Consumers to communicate privacy preferences through recognized browser or device signals.

Where legally required, Zinifly will recognize qualifying universal opt-out preference signals, including Global Privacy Control (“GPC”), for the purposes to which the applicable law applies.

Depending on applicable law, GPC may communicate a request to opt out of:

  • sale of personal information;
  • sharing for cross-context behavioral advertising; and/or
  • targeted advertising.

A GPC signal generally applies to the browser or device transmitting the signal unless Zinifly can lawfully associate the signal with an authenticated account.

Where required by law, Zinifly will provide a reasonable method of indicating that the applicable opt-out preference has been recognized.

GPC does not necessarily disable every cookie.

For example, Strictly Necessary Cookies required for security, authentication, fraud prevention, or requested services may continue operating.

DO NOT TRACK

Some browsers transmit a legacy “Do Not Track” or “DNT” signal.

There is no universally accepted technical or legal standard governing all DNT signals.

Accordingly, Zinifly does not necessarily respond to legacy DNT signals except where required by applicable law.

Zinifly does, however, process legally recognized universal opt-out preference signals where required, as described in Section 10.

U.S. SALE, SHARING AND TARGETED-ADVERTISING OPT-OUTS

Zinifly does not sell personal information for monetary payment in the conventional sense.

However, certain advertising or analytics arrangements may be considered a “sale,” “sharing,” or targeted advertising under broadly defined U.S. state privacy statutes.

Where applicable, you may exercise an opt-out through:

  • Your Privacy Choices;
  • Zinifly's Cookie Preference Center;
  • an applicable recognized universal opt-out signal; or
  • another method described in the Zinifly Privacy Policy.

Opting out of targeted advertising does not necessarily prevent Zinifly from displaying contextual or non-personalized advertisements.

CALIFORNIA PRIVACY CHOICES

Where the California Consumer Privacy Act, as amended (“CCPA”), applies, California Consumers may have the right to opt out of:

  • sale of personal information; and
  • sharing of personal information for cross-context behavioral advertising.

Zinifly will honor qualifying opt-out preference signals where required by California law.

Where advertising technologies constitute sale or sharing under California law, Users may also exercise their applicable rights through Zinifly's Your Privacy Choices mechanism.

Zinifly will not knowingly sell or share personal information concerning Consumers under sixteen (16) without authorization required by applicable law.

OTHER U.S. STATE PRIVACY RIGHTS

Residents of certain U.S. states may have rights to opt out of:

  • sale of personal data;
  • targeted advertising; and
  • certain qualifying profiling.

Where required by law, Zinifly will recognize legally applicable universal opt-out mechanisms.

Rights vary by state and may be subject to statutory thresholds, definitions, exclusions, and exceptions.

MARKET OWNER WEBSITES AND CUSTOM DOMAINS

Zinifly enables Market Owners to create and operate websites, Marketplaces, subdomains, and, on certain plans, custom-domain websites.

Some cookies on those websites may be placed or controlled by Zinifly.

Market Owners may also add:

  • custom JavaScript;
  • custom code;
  • analytics services;
  • advertising pixels;
  • social-media integrations;
  • embedded videos;
  • marketing tools;
  • chat widgets;
  • forms;
  • or other third-party technologies.

When a Market Owner independently selects or deploys such technologies, the Market Owner may be independently responsible for complying with applicable:

  • privacy laws;
  • cookie laws;
  • consent requirements;
  • advertising laws;
  • disclosure requirements; and
  • opt-out requirements.

Market Owners must not use Zinifly customizations to:

  • circumvent Zinifly privacy controls;
  • override consent preferences;
  • activate tracking unlawfully;
  • misrepresent tracking practices;
  • collect undisclosed personal information;
  • or interfere with legally required privacy signals.

Zinifly may disable custom scripts or technologies that Zinifly reasonably believes create a legal, security, privacy, or operational risk.

ZINIFLY-POWERED MARKETPLACES

A Zinifly-powered Marketplace may involve technologies controlled by both:

  • Zinifly; and
  • the applicable Market Owner.

Where Zinifly determines the purpose of a cookie, this Cookie Policy applies to Zinifly's use.

Where a Market Owner independently determines to deploy its own technology, the Market Owner should provide information concerning its use through its own privacy or cookie notice where required.

A Market Owner's use of independent third-party tracking does not automatically mean Zinifly uses that technology for Zinifly's own purposes.

PAYMENT COOKIES

Payment providers may use cookies or similar technologies to:

  • securely process transactions;
  • authenticate payment methods;
  • detect fraud;
  • identify suspicious activity;
  • maintain payment sessions;
  • comply with legal requirements; and
  • protect payment networks.

Some payment technologies may qualify as Strictly Necessary when required to complete a transaction specifically requested by the User.

Payment providers may independently process information under their own privacy policies.

ANALYTICS

Zinifly may use analytics technologies to measure Platform performance and understand how the Platform is used.

Where legally permissible, analytics may include:

  • aggregate traffic;
  • page views;
  • feature usage;
  • device characteristics;
  • referral information;
  • error data;
  • conversions; and
  • interaction data.

Where applicable law requires consent for nonessential analytics technologies, Zinifly will seek appropriate consent before intentionally activating those technologies.

Where consent is not legally required, other privacy rights, including applicable opt-out rights, may still apply.

ADVERTISING TECHNOLOGIES

Zinifly may use advertising technologies from time to time to promote Zinifly products and services.

Advertising technologies may process:

  • cookie identifiers;
  • IP-derived information;
  • browser information;
  • page-view information;
  • referral information;
  • device characteristics;
  • conversion activity; and
  • advertising interaction information.

Zinifly should activate advertising technologies only in accordance with applicable legal requirements and the User's applicable privacy choices.

If Zinifly is not using targeted-advertising technologies at a particular time, the presence of this Section does not mean such technologies are necessarily active.

The current Cookie Preference Center should identify technologies actually enabled.

SOCIAL MEDIA AND EMBEDDED CONTENT

Certain Platform pages may contain links, buttons, videos, widgets, or embedded content supplied by third-party services.

Simply linking to a third-party website does not necessarily cause that service to place a cookie through Zinifly.

Embedded content, however, may permit the provider to access information from the User's device.

Where such technologies require consent, Zinifly should configure them so they do not intentionally activate before applicable consent is provided.

The applicable provider should be identified in Zinifly's current cookie inventory where required.

BROWSER CONTROLS

Most web browsers allow you to manage cookies.

Depending on your browser, you may be able to:

  • view stored cookies;
  • delete cookies;
  • block all cookies;
  • block third-party cookies;
  • block cookies from particular websites;
  • clear website data when the browser closes; and
  • configure privacy settings.

Blocking all cookies may impair Platform functionality.

In particular, disabling Strictly Necessary Cookies may prevent you from:

  • signing in;
  • completing purchases;
  • maintaining a shopping cart;
  • using account features;
  • maintaining security preferences; or
  • completing other requested actions.

MOBILE DEVICES

Mobile devices and browsers may provide additional privacy controls concerning:

  • advertising identifiers;
  • tracking permissions;
  • application permissions;
  • location;
  • local storage; and
  • cross-application tracking.

Those controls are provided by the relevant operating-system or device provider.

Changing device-level preferences may affect how certain third parties process information.

THIRD-PARTY OPT-OUT TOOLS

Certain third-party providers may offer their own privacy or advertising opt-out tools.

For example, analytics providers may provide mechanisms allowing Users to limit analytics tracking.

Using a third-party opt-out does not necessarily communicate all privacy choices to Zinifly.

Where applicable, Zinifly recommends using its own Cookie Preference Center or Your Privacy Choices mechanism in addition to any third-party controls.

EFFECT OF REJECTING COOKIES

Rejecting nonessential cookies will not ordinarily prevent access to the Platform's core public functionality.

However, depending on the feature, rejecting optional cookies may affect:

  • personalization;
  • saved preferences;
  • embedded content;
  • mapping;
  • analytics;
  • social-media features;
  • videos;
  • or other optional functionality.

Strictly Necessary Cookies may remain active.

Market Owners who add custom tracking technologies to a Zinifly-powered website are responsible for ensuring their use complies with applicable law.

This includes, where applicable:

  • identifying the technology;
  • identifying the provider;
  • identifying the purpose;
  • establishing an appropriate legal basis;
  • obtaining required consent;
  • honoring opt-outs;
  • honoring universal privacy signals;
  • maintaining appropriate contracts;
  • updating their privacy disclosures; and
  • ensuring that tracking does not activate contrary to a User's legally applicable privacy preference.

Use of custom code or third-party integrations in violation of privacy or tracking laws may result in restriction or suspension under the Zinifly Terms of Service.
